Sacramento, CA (September 3, 2024) – A disabled woman is taking legal action against a North Highlands restaurant for allegedly violating the Americans with Disabilities Act (ADA). Meryl Pomponio filed a lawsuit on August 23, 2024, in Sacramento Superior Court against Pinnacle Hospitality Group LLC and Lojon Property 71 LLC, the owner and operator of the Long John Silver’s restaurant at 3605 Elkhorn Boulevard.
Pomponio, who suffers from Paraneoplastic Syndrome, claims that she was denied full access to the restaurant in February 2024 due to various accessibility barriers. These barriers included heavy doors, inaccessible restrooms, and other physical obstacles that prevented her from enjoying the restaurant’s services.
Pomponio’s attorney, Daniel Malakauskas, argues that the defendants were aware of these accessibility issues and had the means to address them but failed to do so. The lawsuit alleges that the restaurant’s failure to comply with ADA regulations constitutes a violation of California’s Civil Code.
Pomponio is seeking damages and injunctive relief to require the defendants to modify their facilities and policies to ensure full accessibility for individuals with disabilities. The case has been assigned Case No.: 243016910 in Sacramento Superior Court.
